What is a social host liability lawsuit?

Social host liability refers to the responsibility you have as a private host to ensure the safety of your guests and third parties. It is not the same as tavern or bar liability. For instance, if one of your guests becomes injured because she became intoxicated, or if she injures someone else as a result of becoming intoxicated while your guest, then you may share some legal responsibility for those injuries.

Courts have not closed the door on these types of lawsuits. The result of each lawsuit depends on the circumstances of the case. Very briefly, if you knew, or should have known, that one of your guests was intoxicated to the extent that she could pose a risk to herself or to other people then you expose yourself to a potential claim if someone is then injured.

How can you keep your guests safe and avoid a lawsuit?

Set the tone for the gathering you are hosting. If you drink alcohol then do so responsibly so that you can monitor your guests’ level of intoxication and safety. Do not over-serve. You may even wish to hire a Smart Serve qualified bartender. Have non-alcoholic options available.

Make sure that your guests are aware of Keys Please and other designated driving services. Arrange for carpooling ahead of time. Check into public transportation options beforehand. You can call a cab or a ridesharing program and even have taxi chits available for those who are unable to drive safely. Allow someone to stay overnight if she cannot get home safely.

By taking some extra precautions you will be able to relax and enjoy time with your friends and family.

How to be Successful at Mediation

Mediation is a form of alternative dispute resolution. It is a means for people to settle disputes or lawsuits outside of court. Most people don’t want to go to court. A neutral third party—the mediator—helps the disputing parties look for a solution that works for them. Mediators, unlike judges, do not decide the case. The mediator's role is simply to help the people involved in a dispute to negotiate with each other in a constructive manner, to gain a better understanding of the interests of all parties, and to find a resolution based on common understanding and mutual agreement.
